Q1. When a subscriber email account and traffic data is requested from Microsoft Corporation by North Yorkshire Police via an application of communication data, what are the policy procedures at North Yorkshire Police to safeguard the reliability of the information.
Q2. What are the procedures if North Yorkshire Police are notified that the email address used by covert standards (or any department) was not gathered by any policing or forensic methods, to put it simply e.g the email address supplied by using a random email address.
Q3. If the Microsoft subscribers’ data via communication data request (Gained by a random email address) had been used as an exhibit in a criminal trial, after learning of using a random email address what policy or procedure would be used to protect the subscriber of any further harm after and prior trial.
Q4. Does the covert standards (or any other department) routinely check any email addresses handed to them to verify the source of such sensitive information before contacting Microsoft Corporation or before using or sharing the data as an exhibit for a criminal trial.
Q5. What happens when the data has been gathered as an exhibit and then transferred to another policing authority. Does North Yorkshire Police routinely inform other policing authorities of these errors.
Q6. Does North Yorkshire Police Notify Microsoft Corporation of misleading of gaining a subscribers details i.e. with no evidence of actually having the email address in the first instance.
Q7. when a police officer signs a statement it states this "This statement is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated in it anything which I know to be false or do not believe to be true." if using a application of communication data using a random email address how does North Yorkshire police protect officers who use incorrect evidence.
