FOI Gypsy, Roma & Traveller Hate Crimes (0649-2022/23)

The purpose of this request is to help us to better understand police recording systems and levels of reported race hate against Gypsy, Roma and Traveller communities.

In the questions, when we refer to ‘you’, we mean the police force that is the recipient of this request.

Q1. Do you record the ethnicity of victims of race hate crimes and incidents?

Q2. Do you record the ethnicity of race hate victims in line with the 2021 Census ethnicity categories?

Q3. Do you disaggregate ethnicity to record whether race hate victims are Roma, Gypsy or Irish Travellers?

Q4. If you do not record the ethnicity of race hate victims, please explain the reasons why.

Q5. How many a) race hate crimes and b) race hate incidents, have been reported to you from 1 November 2021 – 31 October 2022, and how many of those victims of race hate were Roma, Gypsy or Irish Travellers?

Q6. How many of the race hate crimes and incidents against Roma, Gypsy and Irish Travellers that were reported to you from 1 November 2021 – 31 October 2022 were referred to the Crown Prosecution Service?

Q7. How many race hate reports against Roma, Gypsy and Irish Traveller that were reported to you from 1 November 2021 – 31 October 2022 have led to a charge or prosecution?

Extent and Result of Searches to Locate Information

To locate the information relevant to your request searches were conducted within North Yorkshire Police. I can confirm that the information you have requested is held by North Yorkshire Police.

Q3. There are Hate Crime strands for Irish Traveller and Romany peoples, not Gypsy.

Q6. We do not provide CPS Data due to how the information is recorded. Please see the exemption explanation below.

I am not obliged to provide you with a response to your request pursuant to Section 12(1) of the Freedom of Information Act 2000 (the Act). Please note that when one part of your request falls under Section 12, we are not obliged to review the rest of the questions and the whole request is therefore exempt. I have however provided you with a response to the rest of your request as a gesture of goodwill.

Section 12(1) applies to your request as the cost of complying with your request is above the amount to which we are legally required to respond i.e. the cost of identifying and retrieving any relevant information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Due to the nature of our recording systems the information requested, if held, is not in an easily retrievable format. In order to retrieve the requested information, it would be necessary to XXmanually review all hate crimes for the period requested to ascertain if the file was sent to CPS. This would involve manually reviewing hundreds of files, which would exceed the time limit allowed under the Act. 

Pursuant to Section 17(5) of the Freedom of Information Act this letter acts as a Refusal Notice.

Pursuant to Section 16 of the Act I am required to offer you advice and assistance with regarding to refining your request to within the ‘appropriate limit’ (time/cost limit). However, due to the information provided above I am unable to suggest how you may refine your request and still receive the information within the cost threshold.  If you wish to discuss this please do not hesitate to contact me.
