Request:
This is a request for information under the Freedom of Information Act. I would like to request the following regarding Operation Infusion and the 2024 policing operation around the Drax Power Station in connection with a planned climate camp. Please provide to date figures where relevant:
Q1. How many meetings were held between your police force and Drax from January 2024 to August 2024? Please break down the number of meetings for each month
Q2. Can you provide emails between Drax employees/executives and the gold commanding officer of Operation Infusion from the 1st of August to the 17th of August
Response:
Extent of Searches to Locate Information
Following receipt of your request searches were conducted within North Yorkshire Police to locate relevant information.
Under Regulation 5(2) of the Freedom of Information (Appropriate Limit and Fees) Regulations 2004, we are permitted to aggregate requests where they relate to any extent to the same or similar information and this aggregation applies to any requests that are received within a sixty working day period, including requests from any one individual or individuals considered to be acting in concert.
In this instance as we have received two requests for information (FOI 0778.2024-25 and FOI 0779.2024-25) within a sixty working day period which are substantially similar to a previous request received on 22 August 2024 that was subsequently refused under section 12 of the Freedom of Information Act (FOI 0454.2024-25). Additionally both new requests have provided the same email address for correspondence.
Therefore under Regulation 5(2) we have aggregated FOI 0778.2024-25 and FOI 0779.2024-25 and engaged s12 of the Freedom of Information Act to refuse both requests. Please refer to the response provided to FOI 0454.2024-25 for more information as to why the cost limit has been exceeded.
Before submitting future requests you should consider which information is of the highest priority to make best use of the processing time within the Act described above. Requests that are to any extent similar that we have identified as being made in concert will be considered together for the purposes of calculating the cost limit. Therefore, we recommend submitting single, complete requests for information across the full timeframe rather than splitting the information you require amongst different requests and time periods as this will not circumvent the cost limit.
Pursuant to Section 17(5) of the Freedom of Information Act this letter acts as a Refusal Notice.
Pursuant to Section 16 of the Act I am required to offer you advice and assistance with regarding to refining your request to within the ‘appropriate limit’ (time/cost limit). However, due to the information provided above I am unable to suggest how you may refine your request and still receive the information within the cost threshold. If you wish to discuss this please do not hesitate to contact me.
Please note that systems used for recording information are not generic, nor are the procedures used locally in capturing the data. It should be noted therefore that this force’s response to your questions should not be used for comparison purposes with any other responses you may receive.
