Q1. Please provide statistics on the disposal of road traffic incidents reported to the North Yorkshire Police by third parties during 2023 using your online portal. Please based this on the categorisations made at the time of initial triage. I anticipate that the categories will be something like the following, together with a number of incidents in each category:
- No further action (evidential)
- No further action (out of time)
- Words of advice
- Formal warning
- Course offer
- Offer of fixed penalty
- Prosecution
Q2. As for question Q1, but instead of including all incidents, please include only those where the reporter's means of transport was pedal cycle.
Extent of Searches to Locate Information
Following receipt of your request searches were conducted within North Yorkshire Police to locate relevant information.
Decision
I am not obliged to provide you with a response to your request pursuant to Section 12(1) of the Freedom of Information Act 2000 (the Act). Please note that when one part of your request falls under Section 12, we are not obliged to review the rest of the questions and the whole request is therefore exempt.
Section 12(1) applies to your request as the cost of complying with your request is above the amount to which we are legally required to respond i.e. the cost of identifying and retrieving any relevant information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.
Due to the nature of our recording systems the information requested, if held, is not in an easily retrievable format. Our information retrieval process generally relies on a computer ran report which captures any information recorded upon the surface of a record or within specified fields. Where relevant information is held deeper in the record, or outside of a specified field, a manual assessment is required to retrieve that information.
For Q2, whether a person accused of a road traffic offence, whilst riding a pedal cycle, under the North Yorkshire Police Operation Snap is not recorded within a specific field that is automatically retrievable. In order to retrieve the requested information, it would be necessary to manually review all submissions for 2023, which would involve more than 1500 reports. This would exceed the time limit allowed under the Act.
I have however, as a gesture of goodwill decided to provide you with the results for Q1 outside of the act.
Please see the table below which details the recorded outcomes for Op Snap submissions for 2023. I note that we are unable to break these down further without extensive manual review.
