Q2. How many times has any planned speed enforcement been carried out on the B1416 Ruswarp Lane (30mph speed limit) or Ruswarp Bank (30mph speed limit) and what were the results year on year for the last 5 years.

Q3. For the same 5 year period and the same locations, has any formal monitoring and recording of traffic speed been carried out and what percentage of vehicles were found to be exceeding the speed limit.

I have therefore decided to exempt providing you with a response pursuant to Section 21 Freedom of Information Act 2000 (the Act).

For Safety Camera Enforcement, we don’t have any locations within the centre of Ruswarp itself, the nearest one being on B1416 Ruswarp Lane within the 30mph zone near to the Mayfield Road roundabout. We’re unable to say the % of vehicles speeding as we don’t keep a log of the total number of vehicles that pass the Safety Camera Vehicle, we just record and process the offences captured at the location.

Section 17 of the Act requires North Yorkshire Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if that would not otherwise be apparent) why the exemption applies.

Section 21 – Information Reasonably Accessible by Other Means

Section 21 is an absolute class based exemption and I am not required to consider the harm or public interest when applying this exemption.

Pursuant to Section 17(1) of the Act this letter acts as a Refusal Notice in response to your request.
